General Conditions
Depending on the restrictions imposed by the Government, we may be obliged to modify these general conditions.
These conditions apply to all sales concluded without an intermediary with Sarl CAP FREDELLE - Bourel – 46260 VARAIRE operating the gîtes L'ESCALE DE VARAIRE and MAISON AUTHENTIQUE DU QUERCY either as furnished rentals or as guest rooms. The customer acknowledges having the required capacity to contract and acquire the services of the gîte: be of legal age, not be under guardianship or trusteeship... The reservation request entails full and unreserved adherence to these conditions of sale and full and unreserved acceptance of their provisions. Reservations made through an online platform are governed by the rules of said platform.
These T&Cs are available to customers on the gîte's Facebook page accessible at the following address https://www.facebook.com/LescaledeVaraire, by email with the quote or credit card receipt or upon simple request from the customer.
① Rates
Prices are indicated in Euros. VAT is always included. The prices indicated only include the services strictly mentioned in the reservation. To this price will be added, when invoicing, the additional services and/or personal expenses (extra) provided by the host during the stay. The prices indicated on the various communication media are subject to change without notice and only the price stipulated in the booking confirmation is contractual. Among other things, they may be modified in the event of legislative and/or regulatory changes likely to result in a price variation (change in the VAT rate, new taxes, etc.). For Pèlerins customers, and upon presentation of a Créantial, Crédential or Carnet de voyage, the overnight or half-board rates are per bed or per room for one or two people and for the number of people indicated in the booking. They include the provision of a fitted sheet, pillowcase, blanket, tourist tax in addition to the current rate. For other customers, the overnight or half-board rates are per bed or per room for one or two people and for the number of people indicated in the booking. They include the provision of a fitted sheet, a pillowcase, a flat sheet, a blanket, the tourist tax will be charged in addition per night and per adult for stays without an intermediary.
② Complaints
Any complaint must be made to SARL CAP FREDELLE within 15 days from the date of stay OR via the booking platform. Any dispute, claim or litigation relating to the terms of booking a stay, a bed or a room are subject to French law, in the absence of a satisfactory response or in the absence of a response within 60 days from the date of receipt of the complaint, the customer may contact the Tourism and Travel Mediator free of charge, whose contact details and terms of referral are available on its website: www.mtv.travel
③ Reservations, Deposit & Payment Methods

Any reservation must be subject to the payment of a deposit either:
• By credit card: upon booking, the customer will receive a link for payment by credit card. At the customer's request, a receipt can be sent to them by email.
Please note: communicating your bank card details constitutes authorization to collect deposits or fixed fees due in the event of cancellation, change of date or shortened stay, theft or damage to the room(s), by bank check (cashed), by bank transfer or via the Paypal platform.
The amount of the deposit is set according to the following rules:
• 30% for a one-night stay (overnight stay and/or half-board)
• The amount of 2 nights for a stay of 4 to 7 nights
• 50% of the stay for stays of more than 7 nights
• For groups, the amount of the deposit and the cancellation conditions will be set according to the specific characteristics of the group (number of people, length of stay, package, etc.) and after written agreement between the parties.
The reservation is only considered firm and final after receipt of the deposit and confirmation of the reservation by us and by any means such as email or text message .
The balance of the stay will be paid on site to SARL CAP FREDELLE, which accepts the following payment methods: cash, PayPal, checks (reservations only), credit cards and bank transfer. For long-term rentals, the bill must be paid every week.
④ Modifying a reservation
A reservation can be modified free of charge up to 2 days before the date of stay for pilgrims, 5 days for other hikers in dormitories. Any modification of a reservation must be requested by or by telephone. The modification of a reservation is only effective after receipt of confirmation from the Gîte ""L'ESCALE DE VARAIRE"".
Requests for modifications may result, where applicable, in the application of the conditions of interruption and cancellation (see 5 and 6). The customer will not be able to claim a refund or compensation.
For all customers other than pilgrims, in the event of a change of stay within 5 days prior to the customer's arrival, a postponement fee of €50 will be charged. The duration of the new stay may not be less than that of the stay initially booked. No postponement fees for pilgrims.
⑤ Conditions for interruption of stay
For any interruption of stay, other than pilgrim, not reported 48 hours before the scheduled departure date, the value of one night will be charged by the host as compensation. If the customer shortens his reservation during the stay, he remains liable for the totality of the nights reserved.
⑥ Cancellation conditions
Any cancellation of a reservation must be requested by email or telephone. The cancellation of a reservation is only firm and final after confirmation of the cancellation by the gîte "L'ESCALE DE VARAIRE" - SARL CAP FREDELLE.
The date of receipt of the cancellation request (by email, post, telephone) is the date retained for the cancellation.
-Pilgrim customers can cancel their reservation up to 48 hours before their arrival at the latest without charge, refundable upon presentation of supporting documents. (such as taxi, train ticket, medical certificate, etc.) for any reservation made directly by telephone, email or mail, with "L'ESCALE DE VARAIRE" - SARL CAP FREDELLE. The deposit paid therefore becomes compensation and will be fully retained by SARL CAP FREDELLE if there is no supporting documentation.
For reservations made via a booking platform: ELLOHA, Cybevasion, Booking, AirBnB, … and their subsidiaries, or a travel operator, the customer must cancel via the site on which he/she booked. The cancellation conditions that apply are then specific to the intermediary through whom he/she booked and may be different from those of the gîte ""L'ESCALE DE VARAIRE"" - SARL CAP FREDELLE.
-Non-pilgrim customers, hikers and other groups detailed in the lodging rates, can cancel their reservation at the latest 5 days before their arrival.without charge, refundable on supporting documents (such as taxi, train ticket, medical certificate, etc.) for any reservation made directly by telephone, email or mail with the gite "L'ESCALE DE VARAIRE" - SARL CAP FREDELLE. The deposit paid becomes compensation and will be fully retained by SARL CAP FREDELLE if there is no supporting documents
In case of no-show, the entire night or nights will be charged or invoiced.
For reservations made via a booking platform: ELLOHA, Cybevasion, Booking, AirBnB, … and their subsidiaries, or a travel operator, the customer must cancel via the site on which they booked. The cancellation conditions that apply are then specific to the intermediary through whom they booked and may be different from those of the Gîte ""L'ESCALE DE VARAIRE"".
⑦ Exclusions from the application of cancellation conditions:
• Death of a family member: a death certificate and proof of family relationship must be provided.
• Hospitalization of the client or an ascendant or descendant: a hospital admission certificate must be provided.
• Major damage to the customer's main residence (fire, destruction): proof to be provided.
⑧ Non-cancellable-non-refundable stays via Booking:
The entire stay is charged upon booking. This stay is non-cancellable, non-refundable, non-modifiable, non-exchangeable. (no change of date, duration or number of participants possible).
Please note: providing your bank card details constitutes authorization to collect the deposit or fixed fees due in the event of cancellation, change of date or shortened stay, theft or damage to the room(s).
⑨ Force majeure
In the event of exceptional events or force majeure, SARL CAP FREDELLE reserves the right to partially or fully accommodate customers in a nearby hotel or accommodation of an equivalent category without additional charge. The costs inherent to the transfer are the responsibility of the lodging. This rehousing solution, accepted or refused by the customer, may not under any circumstances give rise to the payment of any compensation.
⑩ Information Technology & Freedoms
In application of the law 78-17, known as data protection and liberties, customers are informed that their reservation is subject to computerized nominative processing. Users have a right of access and rectification of the data entered, which is exercised at the head office: SARL CAP FREDELLE « L'ESCALE DE VARAIRE » – Bourel – 46260 VARAIRE. It is specified that this information is not communicated to third parties. The Gîte offers Wi-Fi internet access. The user client undertakes that the computer resources made available to him will not be used in any way for the purposes of reproduction, representation, provision or communication to the public of works or objects protected by copyright, by a related right such as texts, images, photographs, audiovisual musical works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code when this authorization is required.
⓫ Applicable law
These General Terms and Conditions of Sale are governed by French law. This applies to both substantive and formal rules. Disputes will fall under the exclusive jurisdiction of the French courts.
